These Terms & Conditions ("Terms") govern your access to and use of osiruth.com and any related services (collectively, the "Site"), operated by Osi Ruth Fashion ("Osi Ruth Fashion", "we", "us", or "our"), having its principal place of business at 1st Floor, 6-4-17B, PAI TOWER, Satya Harishchandra Marg, Chitpady Shobha Bakery, Chitpady, Udupi, Udupi, Karnataka, 576101

By accessing or placing an order on the Site, you ("you", "your", or "User") agree to be bound by these Terms, our Privacy Policy, and our Return & Cancellation Policy, each of which is incorporated by reference. If you do not agree to these Terms, please do not use the Site.


1. Eligibility

You must be at least 18 years of age, or accessing the Site under the supervision of a parent or legal guardian, to place an order on the Site. By using the Site, you represent that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.


2. Account Registration

You may be required to create an account to place an order. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorised use of your account.


3. Products, Pricing, and Availability

  • All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions and specifications at any time without prior notice.
  • Prices listed on the Site are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless stated otherwise.
  • We make reasonable efforts to display product colours, fabric, and craftsmanship (including handloom/artisanal weaves such as Jamdhani) accurately; minor variations may occur due to the handcrafted nature of certain products, screen/display settings, or photography, and do not constitute a defect.
  • In the event of a pricing or listing error, we reserve the right to cancel the affected order and issue a full refund.
  • We make every reasonable effort to accurately display the colours, textures, fabrics, and craftsmanship of our products. However, due to the handcrafted nature of certain products (including handloom and artisanal weaves such as Jamdhani), natural variations in weave, texture, pattern, colour, or finish may occur. In addition, product colours may appear differently depending on your device’s display settings and photography conditions. Such variations are inherent characteristics of handcrafted products and shall not be considered defects or grounds for return or refund.


4. Order Acceptance

Your order constitutes an offer to purchase. All orders are subject to acceptance and confirmation by us, which is communicated via an order confirmation email/SMS or WhatsApp message. We reserve the right, at our sole discretion, to refuse or cancel any order — including for reasons such as suspected fraud, unauthorised or illegal activity, product unavailability, pricing errors, or repeated failed/returned Cash on Delivery attempts flagged through our fraud-prevention and checkout partners.


5. Fraud Prevention and Checkout Partners

To improve checkout security and reduce fraudulent or fake orders (particularly on Cash on Delivery), we use third-party checkout and risk-assessment technology, including GoKwik. These partners may assess order risk using data such as order history, device information, and delivery pincode, and may request additional verification (such as an OTP) before an order is confirmed. Use of the Site's checkout constitutes your consent to such verification.


6. Payments

  • We accept payments through the payment methods displayed at checkout, which may include credit/debit cards, UPI, net banking, wallets

All payments are processed through RBI-authorised, PCI-DSS compliant payment gateways/aggregators. We do not store your full card or bank account details on our servers.

  • In case of a failed transaction where an amount has been debited from your account, the amount is typically reversed by your bank/payment provider within their standard timelines; please retain your payment reference for any related query.


7. Shipping and Delivery

  • We aim to dispatch and deliver orders within the timelines indicated on the Site or at checkout. Delivery timelines are estimates and may vary due to logistics, courier delays, weather, or circumstances beyond our control.
  • Risk of loss and title to products pass to you upon delivery to the shipping address provided at checkout.
  • It is your responsibility to provide an accurate and complete delivery address and contact number.


8. Returns, Exchanges, and Cancellations

Returns, exchanges, and order cancellations are governed by our Return & Cancellation Policy, available at osiruth.com/policies/refund-policy, which forms part of these Terms.


9. Intellectual Property

All content on the Site — including the Osi Ruth Fashion name and logo, product designs, photographs, text, graphics, and layout — is the property of Osi Ruth Fashion or its licensors and is protected under Indian copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.


10. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Place fraudulent orders, including repeated fake Cash on Delivery orders.
  • Attempt to gain unauthorised access to the Site, other user accounts, or our systems.
  • Upload or transmit any viruses, malicious code, or content that is defamatory, obscene, or unlawful.
  • Scrape, copy, or misuse product data, pricing, or images for commercial purposes without authorisation.


11. Third-Party Links and Services

The Site may link to or integrate with third-party services (including our checkout partner GoKwik, payment gateways, and social media platforms). We are not responsible for the content, accuracy, or practices of third-party services, which are governed by their own terms and policies.


12. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly provided under the Consumer Protection Act, 2019 or other applicable law.


13. Limitation of Liability

To the fullest extent permitted under applicable law, Osi Ruth Fashion shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased, and our aggregate liability in respect of any order shall not exceed the amount paid by you for that order. Nothing in these Terms limits any liability that cannot be excluded under applicable Indian consumer protection law.


14. Indemnification

You agree to indemnify and hold harmless Osi Ruth Fashion, its officers, employees, and partners from any claims, losses, or damages arising from your breach of these Terms or misuse of the Site.


15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 16 (Dispute Resolution) below, the courts at UDUPI, KARNATAKA shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms, without regard to conflict-of-law principles.


16. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably through good-faith negotiation within 30 days. If unresolved, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed mutually by the parties, with the seat and venue of arbitration being the jurisdiction city specified in Section 15, and the proceedings conducted in English. This clause does not affect your right, as a consumer, to approach the appropriate consumer forum/commission under the Consumer Protection Act, 2019.

18. Amendments

We reserve the right to modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date and will take effect immediately upon posting. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
