This Privacy Policy describes how Osi Ruth Fashion ("Osi Ruth Fashion", "we", "us", or "our") collects, uses, discloses, and protects your personal information when you visit or make a purchase from osiruth.com, including any related sub-domains, mobile-optimised pages, or checkout flows (collectively, the "Site" or "Services"). This Policy is published in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023, and applies to all users of the Site, whether visitors, registered customers, or otherwise.

By accessing or using the Site, you agree to the collection, use, and disclosure of your information as described in this Policy. If you do not agree with this Policy, please discontinue use of the Site.

1. Information We Collect

1.1 Information You Provide Directly

  • Contact details — name, delivery and billing address, email address, and phone number.
  • Order information — items purchased, size/variant selections, order value, and order history.
  • Account information — username and password, if you choose to create an account.
  • Payment-related information — such as billing name and address; card, UPI, netbanking, or wallet details are collected and processed directly by our payment gateway and checkout partners (including GoKwik and Shopify Payments/associated processors), and are not stored on our own servers.
  • Communications — details you share when contacting our customer support, such as through email, WhatsApp, or the Site's contact form.

1.2 Information Collected Automatically

  • Device and usage data — IP address, browser type, device identifiers, pages viewed, referring URLs, and time spent on the Site.
  • Cookies and similar technologies — used for cart persistence, login sessions, analytics, personalisation, and advertising. See Section 3 below.
  • Approximate location — inferred from your IP address, used primarily for shipping estimation and fraud prevention.

1.3 Information from Third Parties

  • Our e-commerce platform (Shopify) and checkout/RTO-reduction partners (such as GoKwik), who help power secure, high-conversion checkout and share order-status and fraud-risk signals with us.
  • Payment aggregators/gateways and banks, who share payment confirmation status (not full card/bank details) to help us fulfil your order.
  • Shipping and logistics partners, who share delivery status updates.
  • Analytics and advertising partners (e.g. Meta, Google), where you have interacted with our ads or pixels, subject to your cookie preferences.

2. How We Use Your Information

  • To process, confirm, and fulfil your orders, including payment processing, shipping, and delivery.
  • To communicate with you about your order, account, or customer support queries.
  • To detect, investigate, and prevent fraudulent, unauthorised, or illegal transactions — including through risk-scoring and verification tools used by our checkout partners such as GoKwik, particularly for Cash on Delivery orders.
  • To personalise your shopping experience and show you relevant products and offers.
  • To send you marketing communications, where you have not opted out (see Section 6).
  • To comply with applicable legal, tax, and regulatory obligations.
  • To improve the Site, our products, and our Services through analytics.

3. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate the Site, remember your cart and preferences, and understand how visitors use the Site. This includes technologies used by our platform provider Shopify (see https://www.shopify.com/legal/cookies) and by our checkout/fraud-prevention partner GoKwik, which may set cookies to identify returning devices and reduce fraudulent or fake orders. You can control or disable cookies through your browser settings; please note that some features of the Site may not function properly if cookies are disabled.

4. How We Share Your Information

We do not sell your personal information. We share your information only as reasonably necessary to operate our business, namely with:

  • Service providers who support the Site and our operations, including our e-commerce platform (Shopify), checkout and fraud/RTO-prevention partner (GoKwik), payment gateways/aggregators, and logistics/courier partners.
  • Professional advisors and regulators, where required to comply with a legal obligation, court order, or governmental request.
  • Business transferees, in the event of a merger, acquisition, or sale of business assets, subject to standard confidentiality protections.
  • Marketing and analytics partners, only where you have consented to marketing communications or cookie-based tracking.

5. Data Storage, Security, and Retention

Your information is stored on secure servers maintained by our platform and infrastructure providers. We use reasonable technical and organisational safeguards — including encryption in transit (SSL/TLS) — to protect your personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We retain personal information for as long as necessary to fulfil the purposes described in this Policy, including to maintain business and tax records as required under Indian law (currently up to 8 years for financial records, unless a longer period is required by applicable law), resolve disputes, and enforce our agreements.

6. Your Rights and Choices

  • Access and correction — you may request a copy of the personal information we hold about you, and ask us to correct inaccurate information.
  • Erasure — you may request that we delete your personal information, subject to our legal and legitimate business retention needs (e.g. tax records).
  • Withdrawal of consent — where we rely on your consent (e.g. for marketing), you may withdraw it at any time by using the unsubscribe link in our emails or by contacting us directly.
  • Grievance redressal — see Section 9 below.

You may exercise these rights by writing to us at the contact details in Section 10. We may need to verify your identity before actioning a request.
